1. Acceptance of these Terms
By accessing or using Vinspe, you agree to these Terms of Use and to our Privacy Policy. If you do not agree with any part of these terms, please do not use the platform.
2. About Vinspe
Vinspe is a social network and community-driven platform for rating, curating and discussing music videos. We do not host the videos themselves: we display embeds from platforms such as YouTube and Vimeo, whose rights belong to their respective owners.
3. Eligibility and Account
To create an account you must be at least 13 years old, or the minimum age required by the law of your country. You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately of any unauthorized use.
4. Content You Submit
When you publish reviews, ratings, comments, lists, profile messages or any other content ("User Content"), you confirm you hold the necessary rights to it and grant Vinspe a non-exclusive, worldwide, royalty-free license to display, reproduce and distribute that content within the platform. You remain the owner of what you publish.
As a social network, Vinspe provides the technical environment for user interactions, but each user is responsible for their own words, conduct and User Content. The author of a message or publication may be held responsible for unlawful acts, including hate speech, defamation, threats or other violations, in accordance with applicable law.
5. Voluntary Contributions
Users can register new music videos and submit corrections to existing entries — such as title, artist, year, country, genre and video link — committing to provide accurate information. Every contribution or correction remains pending until it is reviewed, and either approved or rejected, by our moderation team.
6. Prohibited Conduct
While using Vinspe, you agree not to:
- Post spam or unsolicited advertising;
- Engage in hate speech or discrimination;
- Harass, threaten or bully other users;
- Post illegal content;
- Spread misinformation;
- Submit false data in contributions or corrections;
- Impersonate another person or entity;
- Infringe copyright or other intellectual property rights;
- Attempt to bypass security or moderation systems.
7. Reporting System
Logged-in users can report inappropriate content directly on the platform.
What can be reported:
- Music video reviews;
- Comments on music videos;
- Messages on a user's profile;
- Comments and topics in groups;
- Users directly.
How to report: next to any of this content there is a discreet flag icon and/or a "Report" button. Clicking it opens a modal where you choose a reason — spam, hate speech, harassment, illegal content, misinformation or other — and may add extra comments. After submitting, you receive a confirmation that the report was received.
You may only report content from other users, not your own, and you cannot report the same content twice.
8. Moderation
Moderators are volunteer users appointed by the administrator. They have access to the Moderation Panel, visible in the site footer or mobile menu when logged in. The panel has three tabs:
Reports — lists every community report, showing the type of content (review, comment, message, etc.), the reason for the report, an excerpt of the reported content, who reported it and who authored it, and a "View context" button that opens the actual page where that content is published, so the moderator can read it in full context before deciding.
Based on that, the moderator has three options:
- Remove content — the content disappears from the platform for everyone, but is kept internally. Vinspe is committed to doing what it reasonably can to cooperate with competent authorities in the event of an investigation.
- Dismiss — the report does not proceed and the content remains visible.
- Ban the author — in addition to removing the content, the user is banned.
An internal ban list keeps every currently banned user, including name, email, ban reason, who applied the ban and when. A moderator may, following a legal challenge or a decision by the administrator, lift a previous ban.
9. Bans
Banned users can no longer log in. If they try, they receive a message explaining that the account was suspended, along with the reason. A ban may be permanent or have an expiration date.
Moderation may ban a user without a prior report if it observes harmful behavior, spam, and/or the submission of false data in music video contributions.
Regarding decision authority, the administrator is also considered a moderator. In case of disagreement, the administrator's decision prevails over other moderators'. Legal decisions are respected above Vinspe's internal decisions, except where an appeal is pending.
10. Becoming a Moderator
Only Vinspe can promote someone to moderator. Users with multiple badges, respectful behavior and language, and frequent participation in the community stand out and may be invited to moderate. Moderators receive a "mod" title visible on their profile. At this time, moderators are volunteers (unpaid).
11. Intellectual Property
Vinspe's trademarks, layout, design and code belong to the platform. Vinspe is a registered trademark. The music videos displayed belong to their respective artists, labels and production companies; Vinspe acts only as an aggregator and showcase of public embeds.
12. Disclaimer and Limitation of Liability
Vinspe is provided "as is". We do not guarantee uninterrupted availability, absence of errors, or that user-submitted content is always accurate. To the maximum extent permitted by law, Vinspe is not liable for indirect damages arising from the use of the platform.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated on the platform. Continued use after an update means you accept the revised terms.
14. Governing Law
These Terms are governed by the laws of the Federative Republic of Brazil, including the Brazilian Civil Rights Framework for the Internet (Law No. 12,965/2014) and, where applicable, the Consumer Protection Code. The user's domicile forum is elected to resolve any disputes, except where the law provides otherwise.
15. Contact
